A civil miscellaneous petition filed for condoning the delay in payment of deficit court fees by an insurance company was dismissed by the Madurai Bench of the Madras High Court.
Justice J. Nisha Banu dismissed the petition saying that the delay could not be condoned as the company had not filed for extension of time for payment. The appellant insurance company had delayed the payment of a sum of ₹3, 080 as court fees for over seven years.
The insurance company had appealed before the High Court against the decree passed by the Motor Accident Claims Tribunal, sub-court, Uthamapalayam.
The court had directed the company to pay the insurance claim in an accident case. However, the company had alleged that the original vehicle involved in the accident had no insurance cover and to claim insurance money another vehicle with insurance cover was recorded.
In its petition before the High Court, the company stated that there was delay in the payment of deficit court fees due to administrative reasons. There was a delay in obtaining sanction from the financial committee for paying the necessary court fees and expenses as the necessary papers were misplaced in its office.
The court directed the Registry to communicate the copy of the order to the Sub-Judge, Motor Accident Claims Tribunal, Uthampalayam, who, in turn, was directed to intimate the parties and the counsel of the dismissal of the petition.
